CODE 3 TAXIDERMY
CUSTOMER TERMS AND CONDITIONS AGREEMENT

By submitting an animal, hide, cape, skull, or other specimen to Code 3 Taxidermy (“Taxidermist”), the customer (“Customer”) acknowledges and agrees to the following terms and conditions.

1. Animal Condition and Responsibility Before Arrival

Code 3 Taxidermy has no control over an animal's condition, handling, care, field dressing, transportation, or storage before it arrives at the shop. The Taxidermist cannot verify the animal's condition prior to receiving it and is not responsible for damage, spoilage, deterioration, or other conditions that develop before the specimen is received.

The Customer understands that the condition of an animal when harvested, how quickly it is field dressed and cooled, the method of handling, and the conditions under which it is transported and stored can significantly affect the final taxidermy result.

2. Hair Slippage, Hide Spoilage, and Natural Defects

The Customer understands that hair slippage, hide damage, spoilage, discoloration, and other defects can occur naturally and may be present before an animal arrives at the shop. Hair slippage may be caused by, but is not limited to:

Bacterial growth, decomposition, and improper cooling or storage.
Illness, disease, or infection in the animal.

Injuries, wounds, or damaged tissue. Poor blood circulation, tissue damage, or other biological conditions.
Warm temperatures, delayed field dressing, improper handling, or delayed freezing.
Other pre-existing or naturally occurring conditions beyond the Taxidermist's control.
Some of these conditions may not be visible when the animal is received and may only become apparent during fleshing, skinning, tanning, or mounting.

Code 3 Taxidermy cannot guarantee that hair slippage, hide failure, or other defects will not occur. The Taxidermist is not responsible for spoilage, hair slippage, or defects caused by pre-existing conditions, biological factors, improper field care, transportation, storage, or other circumstances outside the Taxidermist's reasonable control.

3. Workmanship and Natural Variation

The Customer understands that taxidermy is a skilled, artistic process involving natural materials. Differences in color, markings, symmetry, antler position, hide characteristics, and overall appearance may occur. The finished mount may not be an exact replica of the live animal or a photograph.

Code 3 Taxidermy will make reasonable efforts to produce a quality mount consistent with the selected pose, specimen condition, and services agreed upon. No guarantee is made regarding defects arising from the specimen's natural condition.

4. Deposits, Pricing, and Payment

A deposit of 50% of the agreed-upon price is required when the specimen is accepted, unless other arrangements are agreed upon in writing. The remaining balance is due when the work is completed and before the finished specimen is released to the Customer.

Any additional work, repairs, special requests, or services beyond the original agreement may result in additional charges. The Customer will be notified of significant additional costs when reasonably possible.
Deposits and payments will be handled according to any applicable written refund or cancellation agreement and applicable law.

5. Turnaround Time

Estimated completion dates are approximate and may change due to workload, specimen condition, tanning requirements, supply availability, or circumstances beyond the Taxidermist's reasonable control. Code 3 Taxidermy will make reasonable efforts to complete work within the estimated timeframe but does not guarantee an exact completion date unless expressly agreed to in writing.

6. Customer Information and Legal Compliance
The Customer represents that they have lawful possession of the animal or specimen and have the authority to submit it for taxidermy services. The Customer is responsible for providing accurate harvest, tag, permit, and other required information and documentation.

Code 3 Taxidermy may refuse or discontinue work if required documentation is missing or if accepting or possessing the specimen would violate applicable law.

7. Finished Mount Pickup and Storage

The Customer is responsible for arranging pickup of the completed mount and paying the outstanding balance. The Taxidermist will make reasonable efforts to contact the Customer when the work is completed.
Any storage deadlines, storage fees, or procedures for unclaimed mounts must be communicated to the Customer in advance and applied in accordance with applicable law. No specimen or completed mount will be disposed of or sold except as permitted by law and any applicable written agreement.

8. Limitations of Responsibility

To the extent permitted by Michigan law, Code 3 Taxidermy is not responsible for loss, damage, spoilage, hair slippage, or defects resulting from pre-existing specimen conditions or circumstances outside the Taxidermist's reasonable control.

Nothing in this agreement is intended to waive rights or excuse conduct for which liability cannot legally be excluded. This agreement does not eliminate responsibility for negligence or other liability where such responsibility cannot lawfully be waived.
